{"id":1830,"date":"2017-07-18T07:19:16","date_gmt":"2017-07-18T05:19:16","guid":{"rendered":"https:\/\/advocatsferrer.com\/jutjats-especialitzats-clausules-sol-han-ingressat-gairebe-16-000-demandes-mes\/"},"modified":"2017-07-18T07:19:16","modified_gmt":"2017-07-18T05:19:16","slug":"jutjats-especialitzats-clausules-sol-han-ingressat-gairebe-16-000-demandes-mes","status":"publish","type":"post","link":"https:\/\/advocatsferrer.com\/ca\/jutjats-especialitzats-clausules-sol-han-ingressat-gairebe-16-000-demandes-mes\/","title":{"rendered":"Jutjats especialitzats en cl\u00e0usules s\u00f2l han ingressat gaireb\u00e9 16.000 demandes en un mes"},"content":{"rendered":"<p style=\"text-align: justify;\">Els jutjats de primera inst\u00e0ncia habilitats en cada prov\u00edncia per gestionar els litigis relacionats amb les cl\u00e0usules s\u00f2l van registrar prop de\u00a0<strong>16.000 demandes (15.801) al juny<\/strong>, segons l'\u00faltima actualitzaci\u00f3 del Consell General del Poder Judicial (CGPJ).<\/p>\n<p style=\"text-align: justify;\">Segons ha informat l'\u00f2rgan de govern dels jutges en un comunicat, es preveu que en el transcurs d'un any els jutjats de primera inst\u00e0ncia especialitzades en cl\u00e0usules s\u00f2l rebin m\u00e9s de\u00a0<strong>190.000 demandes sobre les cl\u00e0usules hipotec\u00e0ries abusives<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Madrid, Barcelona i Val\u00e8ncia s\u00f3n les prov\u00edncies que m\u00e9s demandes han ingressat en el primer mes de funcionament. La capital ha rebut 2.803 demandes, seguides de les 1.033 de la ciutat comtal i les 834 de Val\u00e8ncia.<\/p>\n<p style=\"text-align: justify;\">Mentrestant, els jutjats de Cant\u00e0bria (185), la Rioja (105), Ceuta (13) i Melilla (2) s\u00f3n les que menys demandes han registrat. Els ciutadans van presentar m\u00e9s de 500 demandes en altres prov\u00edncies com Ja\u00e9n, M\u00e0laga, Sevilla, Saragossa i Biscaia.<\/p>\n<p><strong>Pla d'urg\u00e8ncia<\/strong><\/p>\n<p style=\"text-align: justify;\">Com a conseq\u00fc\u00e8ncia de la sent\u00e8ncia del\u00a0<strong>Tribunal de Just\u00edcia de la Uni\u00f3 Europea (TJUE)<\/strong>\u00a0de 21 de desembre de 2016 a relaci\u00f3 amb les cl\u00e0usules s\u00f2l, el CGPJ va posar en marxa un pla d'urg\u00e8ncia davant el previsible augment de litigis. El pla es va posar en funcionament l'1 de juny de 2017 que consisteix en l'especialitzaci\u00f3 d'un jutjat de primera inst\u00e0ncia per prov\u00edncia a la pen\u00ednsula i un a cadascuna de les principals illes dels arxip\u00e8lags canari i balear.<\/p>\n<p style=\"text-align: justify;\">Per posar en marxa aquest pla, l'\u00f2rgan de govern dels jutges va mantenir reunions amb els presidents dels\u00a0<strong>Tribunals Superiors de Just\u00edcia<\/strong>, amb una representaci\u00f3 dels jutges degans, amb el Ministeri de Just\u00edcia i comunitats aut\u00f2nomes amb compet\u00e8ncies transferides en aquesta mat\u00e8ria. L'objectiu era coordinar les mesures previstes i avaluar les possibles necessitats.<\/p>\n<p style=\"text-align: justify;\">La primera reuni\u00f3 va tenir lloc el passat 31 de maig, on hi va haver un comprom\u00eds per part de totes les administracions a col\u00b7laborar en aquest pla d'urg\u00e8ncia.
