En aquest cas es tracta d\u2019una <strong>hipoteca<\/strong> a la qual se li aplicava un inter\u00e8s de demora del 16% que el jutge ha considerat abusiu i per aquesta ra\u00f3 l'ha anul\u00b7lat.<\/p>\n<p>La sent\u00e8ncia, contra la que es pot presentar recurs, t\u00e9 en compte que l\u2019inter\u00e8s legal dels diners en el moment de la firma de la hipoteca era del 3,75%, molt inferior al 16% fixat en la cl\u00e0usula d'inter\u00e8s per demora, que actualment hauria de ser del 15% i no del 16% tal com es va aplicar a aquest cas.<\/p>\n<p>La sent\u00e8ncia del Tribunal de Just\u00edcia de la\u00a0UE\u00a0de 14 de juny de 2012 ens diu que no es pot recalcular un tipus d'inter\u00e8s de demora que no sigui abusiu perqu\u00e8 llavors al professional bancari \"li interessaria sempre un inter\u00e8s moratori abusiu en el contracte,\u00a0doncs\u00a0el pitjor que podria passar \u00e9s que es redu\u00eds al l\u00edmit legal\".<\/p>\n<p>Aix\u00ed, \"l'\u00fanica manera de desincentivar l'ab\u00fas \u00e9s que la sanci\u00f3 sigui l'exclusi\u00f3 de qualsevol inter\u00e8s moratori\", entenem doncs que en molts casos s\u2019ha aplicat l'inter\u00e8s m\u00e9s alt tot i que no s\u2019ajusti als l\u00edmits legals i esperant que l\u2019arrendatari no se n\u2019adoni.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>S'anul\u00b7len els interessos moratoris d'una hipoteca per ser considerats abusius\u00a0al Jutjat de primera inst\u00e0ncia 7 de Sabadell.
